These Terms of Service govern your use of wolfandsparrow.studio and your purchases from Asakas LLC dba Wolf & Sparrow Studio (“Wolf & Sparrow Studio,” “Company,” “we,” “our,” or “us”).

By accessing our website, placing an order, purchasing from us in person, or otherwise using our services, you agree to these Terms of Service and any policies referenced within them.

If you do not agree with these Terms, please do not use our website or services.

1. General Conditions

You may use our website and services only for lawful purposes.

By using this website or purchasing from Wolf & Sparrow Studio, you represent that you are legally capable of entering into a purchase transaction or are using the website with the permission of a parent or legal guardian.

You may not use our products, website, branding, artwork, content, or services for any unlawful or unauthorized purpose.

We reserve the right to refuse or cancel service, orders, or transactions when reasonably necessary, including in cases of suspected fraud, abuse, policy violations, payment issues, inventory errors, or other legitimate business reasons, subject to applicable law.

2. Products & Product Information

Wolf & Sparrow Studio sells apparel, headwear, accessories, artist collaborations, and other merchandise.

We make reasonable efforts to accurately display product photographs, descriptions, colors, sizing, materials, pricing, and other information.

However:

  • Colors may appear differently depending on your screen or device.
  • Measurements and sizing information are approximate.
  • Garment-dyed, handmade, hand-finished, small-batch, or similar products may contain minor variations.
  • Product photographs may not perfectly represent every individual item.
  • Manufacturers may make minor changes to blank garments, materials, or specifications.

Minor variations that do not materially affect the intended use of a product are not necessarily considered defects.

We may modify, discontinue, restock, or limit products at any time.

Product availability is not guaranteed.

3. Limited Releases, Pre-Orders & Made-to-Order Products

Some products may be offered as limited releases, pre-orders, or made-to-order products.

When a product has a special production or fulfillment timeline, we will make reasonable efforts to disclose that information on the product page.

Estimated production, release, or fulfillment dates are provided in good faith but may change because of manufacturing, supplier, shipping, or other delays outside our reasonable control.

Placing a pre-order does not guarantee an exact delivery date.

Cancellation, return, and exchange eligibility for these products is governed by our Return & Refund Policy and any additional terms clearly disclosed on the applicable product page.

4. Pricing, Taxes & Payment

All prices displayed on our U.S. storefront are listed in U.S. dollars unless otherwise stated.

We reserve the right to change product prices at any time.

Applicable sales tax or other legally required charges will be calculated and collected when required.

Payment must be successfully authorized before an order is fulfilled.

If a product is displayed with an obvious pricing, inventory, or other material error, we reserve the right to correct the error or cancel the affected order.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

Discount codes, promotions, rewards, and other offers:

  • May have eligibility requirements
  • May have expiration dates
  • May not be combined unless expressly permitted
  • May be modified or discontinued when allowed by law

5. Orders

Submitting an order does not necessarily mean that we have accepted it.

We may review an order before fulfillment and may contact the customer if additional information is reasonably necessary.

We may cancel or limit an order because of:

  • Inventory errors
  • Payment problems
  • Suspected fraud
  • Incorrect pricing
  • Shipping or delivery restrictions
  • Excessive quantities
  • Technical errors
  • Other legitimate operational reasons

Customers are responsible for reviewing product selections, sizes, colors, quantities, delivery methods, and addresses before submitting an order.

Once an order has entered processing, production, or fulfillment, changes or cancellations may not be possible.

6. Shipping, Local Delivery & Pickup

Shipping, local delivery, and pickup are governed by our separate Shipping Policy.

Wolf & Sparrow Studio currently offers U.S. shipping and may also offer local delivery and local pickup to eligible customers.

Customers are responsible for providing accurate shipping, delivery, and contact information.

Carrier transit times and estimated delivery dates are not guaranteed.

Wolf & Sparrow Studio is not responsible for delays caused by carriers, weather, holidays, natural events, incorrect customer information, or other circumstances outside our reasonable control.

Please review our Shipping Policy for current rates, processing times, local-delivery requirements, pickup procedures, and lost or damaged shipment procedures.

7. Returns, Exchanges & Refunds

Returns, exchanges, refunds, damaged items, defective items, and cancellations are governed by our separate Return & Refund Policy.

By completing a purchase, you agree to the return and refund terms in effect at the time of your order.

Certain products may be final sale when clearly identified as such.

8. Intellectual Property

The Wolf & Sparrow Studio website and brand contain intellectual property owned by or lawfully licensed to Asakas LLC.

This may include:

  • Wolf & Sparrow Studio names and branding
  • Logos
  • Original designs
  • Graphics
  • Photographs
  • Website content
  • Written copy
  • Product artwork
  • Layouts and creative materials

Some products, including products released through the Wolf & Sparrow Artist Collection, may contain artwork or intellectual property owned by independent artists or other third parties and used by Wolf & Sparrow Studio under license or other authorized arrangement.

Nothing on this website transfers ownership of any artwork, copyright, trademark, design, photograph, or other intellectual property to a customer or website visitor.

You may not reproduce, copy, modify, distribute, manufacture from, resell, commercially exploit, or otherwise use Wolf & Sparrow Studio content or licensed artist content without permission from the applicable rights holder.

Purchasing a physical product does not grant the purchaser intellectual-property rights in the artwork or design appearing on that product.

9. Artist Collaborations

Products identified as artist collaborations may feature artwork owned by independent artists and licensed to Wolf & Sparrow Studio.

The artist's participation in an Artist Collection release does not necessarily mean that Wolf & Sparrow Studio owns the underlying artwork.

Artist names, artwork, and collaboration materials remain subject to the applicable ownership and licensing rights between Wolf & Sparrow Studio and the collaborating artist.

Customers receive ownership of the physical product purchased, not ownership of the artwork or intellectual property appearing on it.

10. Customer Content & Social Media

Customers may voluntarily share reviews, photographs, social media posts, comments, or other content relating to Wolf & Sparrow Studio products.

If you directly submit content to Wolf & Sparrow Studio for promotional use, tag or mention Wolf & Sparrow Studio in public content, or otherwise clearly invite us to share your content, we may repost or share that content through our website or social media channels.

You retain ownership of your original content.

We will not claim ownership of a customer's original photograph or other creative work merely because it features a Wolf & Sparrow Studio product.

If you would like us to remove customer-created content that we have reposted, contact us through our official social media accounts and we will review the request.

11. Reviews & Communications

Reviews, comments, messages, or other customer communications must not:

  • Contain unlawful or threatening material
  • Infringe another person's intellectual property
  • Impersonate another person
  • Contain malicious software or harmful code
  • Be submitted fraudulently or deceptively

We may moderate or remove content from areas we control when reasonably necessary.

12. Third-Party Services

Our website may use third-party services, applications, payment processors, shipping carriers, social media platforms, loyalty programs, or other technology providers.

Examples may include Shopify, payment providers, shipping carriers, and third-party Shopify applications.

Your use of certain third-party features may also be governed by that provider's terms and privacy practices.

Wolf & Sparrow Studio is not responsible for third-party websites or services that we do not control.

We make reasonable efforts to keep the website functioning and information current, but we do not guarantee uninterrupted or error-free access.

The website may occasionally experience:

  • Incorrect inventory information
  • Display errors
  • Temporary service interruptions

We may correct website errors or update information when discovered.

14. Prohibited Uses

You may not use the website or our services to:

16. Limitation of Liability

To the fullest extent permitted by applicable law, Asakas LLC dba Wolf & Sparrow Studio will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website, services, or products.

This limitation does not apply where liability cannot legally be limited or excluded.

Nothing in these Terms is intended to waive consumer rights provided by applicable law.

Customers are responsible for using products in a reasonable and intended manner.

Wolf & Sparrow Studio is not responsible for damage or injury caused by misuse, unauthorized modification, failure to follow care instructions, or use of a product for a purpose for which it was not intended, to the extent permitted by law.

Customers with allergies or sensitivities should review available product materials and descriptions before purchase.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Asakas LLC dba Wolf & Sparrow Studio from claims, losses, liabilities, or reasonable expenses arising from your unlawful misuse of our website or services or your violation of these Terms.

This provision does not apply to claims resulting from Wolf & Sparrow Studio's own unlawful conduct where liability cannot legally be transferred.

19. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law or other mandatory law applies.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

21. No Waiver

If Wolf & Sparrow Studio does not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce it.

These Terms, together with our applicable:

  • Return & Refund Policy
  • Product-specific terms

constitute the applicable agreement between the customer and Wolf & Sparrow Studio regarding use of the website and purchases from us.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, website, products, policies, or applicable requirements.

The updated version will be posted on this website with a revised Last Updated date.

Continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.
